Bookings

-Provisional Confirmation of Availability

Upon receipt of a request for availability, the applicable villa rates and the amount of deposit required will be confirmed.

- Exclusions & Additional Charges

Airport transport is provided at rates specified by villa management. Rates do not include baggage handling, gratuities, telephone, fax and telegram charges, car rental, food, soft drinks and/or liquor, personal items and expenses, and any excessive cleaning required upon departure, (such as upholstery or rug shampooing, etc), or replacement of breakages. Fair wear and tear accepted.

- Initial Deposit

An initial deposit of 50% of the villa rental is required to confirm a booking. No contractual obligation will exist prior to receipt of funds. If funds are not received within 5 banking days, the reservation shall be deemed to have been cancelled.

For bookings of less than one week, or bookings made within 30 days of arrival, full payment is required at the time of reservation.

Rates

Villa rental rates quoted by "Baan Sawan" are on a per day basis and quoted in US dollars.

Rates quoted allow for maximum occupancy of the villa as shown on the web site. Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. Rates include services of a representative to meet guests at the airport on Koh Samui and escort them to their villa.

The cost of electricity, water, cleaning and gardening supplies, local taxes, and so on are included in the rental rates. "Baan Sawan" is fully equipped with linen, crockery, utensils, and an initial supply of soap and toiletries.

Balance Payment

Payment of the outstanding balance must be received at least 30 days before the arrival date. Should "Baan Sawan" not receive the balance by the due date, we reserve the right to cancel the booking, and cancellation charges will apply.

Cancellation

You may cancel your reservation at any time by notifying us in writing by email. The following cancellation terms apply: more than 30 days prior to arrival: forfeiture of the deposit; less than 30 days prior to arrival: total cost. If it becomes necessary to cancel all or any part of the booking, you must notify us by email. The cancellation will take effect from the day the written confirmation is received. The above cancellation charges also apply if "Baan Sawan" cancels the booking due to non-payment of the balance.

Amendment to Booking

A $50 administration fee will be charged by "Baan Sawan" for any change to the booking after a confirmation has been issued. Acceptance of any change is subject to approval by the villa's owner.

Arrival & Departure Times

Guests should assume the check-in time is after 3 pm, and checkout time is prior to 11 am, unless otherwise specified or agreed. Account will be taken where possible of flight arrival/departure times.

Alteration or Cancellation by "Baan Sawan"

In the unlikely event that "Baan Sawan" or the villas owners/management have to make any changes to confirmed bookings, we will advise you at the earliest possible date.

If a property is damaged or rendered unusable, or if for any reason beyond our control or due to unexpected circumstances we are unable to provide you with the villa booked, "Baan Sawan" or the villa owners/management shall reserve the right to cancel the reservation. However, "Baan Sawan" or the villas owners/management will endeavor to locate an alternative property for the required period. If this is not possible, or you do not wish to be transferred, the villa owners/management or we will cancel the booking and refund you in full, less any bank transfer charges.

"Baan Sawan" shall not be liable for any further obligations or claims by the client.

Registered Guests

Only those persons stipulated on the booking form may reside at the property as guests. Please notify us as soon as possible of any changes. The number of people staying at the property must not exceed the maximum capacity specified, except in the case of infants (under two years old), or unless specifically authorised.

Should the owner/management of the villas or a "Baan Sawan" representative find that the number of people staying at the property exceeds that on the booking form, additional guests will be subject to a per person, per day surcharge and/or may be asked to vacate the premises.

No camping is permitted in the property grounds and "Baan Sawan" regrets that no pets are allowed.

In line with their Corporate Responsibility, the management of "Baan Sawan" reserve the sole and exclusive right to request any guest to vacate a property in the event of any of the following cases:

1- male or female joiners are invited over to the property, as non registered guests

2- any illegal activities with under-age individuals are witnessed (guests would be summoned to the local police)

3- any other illegal or immoral activities are done within the private boundaries of the property (including: use of illegal drugs, illicit pictures, illicit movie production)

No refund would be applicable.

Security Deposit

While not generally required, a security deposit may be payable to the villas owners/management on arrival. This is to cover the cost of any damage or breakages during the rental period to the villa or its contents. The security deposit may also be used to cover incidental expenses for optional services rendered on site. Security deposit payments should be refunded on departure, less any applicable costs. "Baan Sawan" does not handle security deposits, and is not liable for any disputes in claims between guests and the respective villa management.

Weddings & Events Security Deposits (to be deposited on or before arrival): THB 50k to 100k (depending on the scale of the event).

Insurance

It is a condition of the booking that the entire party is covered by comprehensive travel insurance of their own (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including local treatment, evacuation and repatriation coverage).

As deposits and rental payments may not be refundable after a reservation has been confirmed, you should consider an option of this travel insurance to cover the loss of money paid to the villa in case you might have to unexpectedly cancel your journey.

"Baan Sawan" and the villas owners/management are not responsible and are held harmless by you and your party against any and all claims including any accidents related to the use of the villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, car or motorbike rental.

"Baan Sawan" and the villas owners/management shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside "Baan Sawan" control, such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc.

By acceptance of this contract it is assumed by "Baan Sawan" and the villas owners/management that this requirement will be complied with in full.

Liability Release

Under no circumstances shall "Baan Sawan" be responsible for any loss, expense, damage, claim or injury either directly or indirectly, consequential or otherwise whatsoever, caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodation as described or substituted, or by reason of military action, revolution or acts of God, or by any agents, employees, subcontractors, servants or third parties whatsoever supplying any of the services or accommodation herein or as substituted.

If any accommodation and/or services are substituted, "Baan Sawan" and the villas owners/management will act at all times in good faith and use its best efforts to substitute with accommodations and/or services of a type comparable to or better than those originally contracted. "Baan Sawan", at its sole and unfettered discretion, reserves the right to refuse or discontinue service to any person (s) and/or to rescind any contract for accommodations or guest services.

Complaints

All properties descriptions provided by "Baan Sawan" on the website and elsewhere are made in good faith.

"Baan Sawan" accepts no responsibility for the following:

- any modifications made by the villas owners/management which are not mentioned on the web page or anywhere else.

- the breakdown of the supply of water, or electricity, or swimming pool filtration systems.

However, shall you contact us during such problem, we will use our best endeavor to arrange for any such problems to be solved quickly. Any complaints must be notified to "Baan Sawan" within 24 hours of the occurrence giving rise to the complaint.

Should a problem remain unsolved please make a complaint in writing to "Baan Sawan" or the villa owners/management within 14 days of the completion of the rental period. If the villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of all rights to compensation.

No claim can be made after the villa has been vacated if notification at the time of the problems occurrence was not made to "Baan Sawan" and/or the villa owners/management.

Conduct & Behaviour

The person making the reservation is held responsible for the correct and appropriate behavior of the guests staying at the villa. Should any member of the party not behave in such a manner, the villa owner/management or "Baan Sawan" representative may at their absolute discretion ask the offending guest(s) to vacate the villa forthwith.

Firearms, deadly weapons, pyrotechnics, prohibited drugs, and gambling are not permitted.

Staff at the Villas

"Baan Sawan" includes the service of one or several staff. Additional services such as those of cooks and/or drivers can usually be sourced. Please give ample notice as soon as possible; especially at peak holiday seasons and we shall try to assist.

"Baan Sawan" assumes no liability for such contracted staff. The rates for these services will be provided in advance and shall be paid by the guests as incurred.

Valuables

"Baan Sawan" is equipped with a safe in one of the rooms, or a safe is available at the villa owners /management office. Any valuables left at the property are at the guests' own risk. Neither "Baan Sawan" nor the villa owners/management nor the villas' staff are to be held responsible for their loss or damage.

Linen & Towels

Linen and towels are included in all villas. These are normally changed every 3 days. If you require more frequent changes there may be extra charges. Limited laundry facilities exist on site, with charges made per item. Outside services are also available for a small service charge and must be paid at the time incurred.

Due Care of the Facilities

As part of this agreement and as "Baan Sawan" is privately owned, guests are required to take due care when residing at the villas, especially of children playing in the gardens, near or in the entrance, the road, the pool. Furthermore, guests are reminded not to enter the villas wet as the floors can be slippery. Damage or injury arising shall not be the responsibility of "Baan Sawan" and/or villa ownwers/management in any way whatsoever.

Handling of furniture, crockery and other artifacts shall be done with maximum care; the villa's staff is there to help if necessary.

Applicable Law

These conditions and any contract to which they apply are governed in all respects by the applicable Thai law, and the Thai courts only shall have jurisdiction in relation to any claim or dispute arising out of, or connected with them.
